The MRO designation is proving to be a major roadblock to the proposed track. The County seems to be standing firm in their recognition of this zoning and enforcement of the County Code.
If MXGP want's to continue to persue this site, they will have to work with Rinker to apply for a rezone, and there's no guarantee that it would be approved. They then would have to reapply for a Conditional Use Permit all over again. Both issues would go before the Hearing Examiner and we would fight them every step of the way. The Contamination, Noise, Traffic and Drainage problems would still be major roadblocks to overcome. We could drag this out for 3-5 years, if that's what it takes, we live here and we are determined.
Hopefully MXGP will realize that this is not the place for their track and that they won't win, and move on to a more suitable location away from quiet communities like ours. Dave Sommers has even offered to help find a more ideal location.

I have spoke with my personal attorney and he has researched this and spoken with Erik Olson from Snohomish County and all of the Rinker Site has been re zoned R5 MRO,at this point the developer is stuck and will have to get the county to change their legislation. I am attaching my last email from my attorney "What is shocking is that the zoning changes were approved in December and not effective until February and the developer still missed the critical deadline for his application by a week. The county cannot grant a "use variance" so the developer must either get the Sno Co Council to change the zoning code with a new amendment or he must seek some kind of administrative interpretation either that (1) the motocross facility is not a "racetrack" under the code or (2) that the MRO map erroneously included the motocross site -- both of which will be pretty difficult. Without such an administrative interpretation, I would think the present permit application would be dead in the water. Even with the legislative change, the developer will probably have to start over. We will have to watch how the developer tries to wiggle free very closely. But all in all, it's pretty good news"

MXGP...good luck and goodbye. Your smart business decision will be to cut your losses and focus on your 4 other candidate sites. Remember, if continue your efforts in Maltby you will be throwing good money after bad. We will NOT allow you to destroy our community for your personal gain.
Let's remember who was on our side and who was not come election time folks. Keep the good ones!
